2.6. Legal Prospective

A future reform of the current Organic Law of Religious Freedom should address the controversial aspects of the right to religious symbols and its boundaries, including the constitutional right to equality.

The introduction of the gender perspective as a limit of the religious freedom is unpostponable and would avoid that Local Governments and Education Centers to assume competencies in matter of fundamental rights.

The Multiculturalism cannot justify the ambiguity and the relativism facing discriminatory religious manifestations that relax the application of equality right infringing the Constitution. The coexistence between civilizations in the European and Spanish space cannot serve as an excuse for a lack of legal protection facing discriminatory religious symbols. In the same way, the subsidies to religions based on discriminatory practices against women should be object reconsideration by the Authorities.

In particular, the risk of religious harassment claims the legislative attention in order to prevent any pressure on the collective of immigrant women and prevent that a future right of living in accordance with religious beliefs, involves a setback in the right of gender equality.
